Construction Dispute Statutes of Limitations and Repose

The Colorado Construction Defect Action Reform Act provides a two-year window during which legal action can be taken against contractors and subcontractors for construction defects. This statute of limitations applies to both new construction and modifications/additions and begins at the point when the defect is discovered or “should have” been discovered. Failure to take action within this time will negatively impact your chances of a suitable resolution.


Different than a statute of limitations, the statute of repose applies to major construction and improvement projects. With the statute of repose, you are generally only able to bring suit against a contractor, subcontractor, designer, architect, and other parties involved in major construction for six years following "substantial completion."
